This blog is designed to helped military dependents and retirees deal with issues of medical malpractice at military medical facilities. Military medical malpractice cases are handled under the Federal Tort Claims Act, if they occur in United States, and under the Military Claims Act, if they occur outside of United States.
I was on active duty as a member of the Navy's Judge Advocate General's Corps from 1983 to 1987. I was a defense counsel, representing individuals a courts-martial, until I won too many cases. My CO gave me the choice of becoming a prosecutor or the claims attorney. I chose claims and spent the rest of my time in the Navy handling medical malpractice, car crash and premises liability claims that were brought against the Navy under the Federal Tort Claims Act. I worked closely with you as attorneys in five different states. From 1987 to 1992 I worked for a 100 attorney law firm doing insurance defense and tried many jury trials in the state court system. Insurance defense made me sick to my stomach. Often I saw individuals take less than the insurance company was willing to offer, because thier attorney was simply scared to try their case. In 1992, I went to work for the lawyer who won the first million-dollar verdict in the state of New Jersey and have been representing individuals harmed by others. I formed my own office in 2003. More than half of my practice involves representing individuals with personal injury cases under the FTCA
